Terms of Service

These Terms of Service (“Terms”) apply to your use of the Jollyjack app for iPhone (the “App”) and the Jollyjack Pro subscription, provided by İrem, the developer of Jollyjack (“we”, “us”, “our”). By downloading or using the App, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.

1. License and Apple’s Standard EULA

The App is licensed to you, not sold, under Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These Terms are additional terms that apply together with the Standard EULA. If these Terms conflict with the Standard EULA, the Standard EULA prevails to the extent of the conflict.

2. What Jollyjack is

  • Jollyjack is an educational simulator for learning blackjack strategy and practicing card counting.
  • There is no real-money gambling and there are no prizes. Virtual chips have no monetary value. They cannot be bought, sold, transferred or exchanged for money or anything of value.
  • Every drill uses cards the App deals itself. The App is not designed or intended for use at a real table. Using any device to count cards at a real table is illegal in many jurisdictions.
  • Results in the App do not predict results at a real table. We do not promise that you will win money.

You are responsible for following the laws and the rules of any venue where you play. Nothing in the App is legal or financial advice.

3. Eligibility

You must be at least 18 years old, or older if the law where you live sets a higher minimum age for content with simulated gambling, to use the App.

4. Your account

You sign in with Apple or Google. You are responsible for keeping access to your Apple or Google account secure and for all activity under your account. You can sign out in Settings › Account › Sign out and delete your account at any time in Settings › Account › Delete account. If your subscription has ended, both are under Account on the “Unlock Jollyjack Pro” screen. Either way, the App returns to the sign-in screen. If you have never subscribed, email us at [email protected] to delete your account (see section 7 of the Privacy Policy).

5. Jollyjack Pro subscriptions

  • Access to the App’s training features requires an active Jollyjack Pro subscription.
  • Jollyjack Pro is an auto-renewing subscription with two plans: yearly (renews every year) and monthly (renews every month). The price of each plan is shown in the App before you purchase and may vary by country or region.
  • The yearly plan includes a 3-day free trial for eligible new subscribers. The monthly plan has no free trial. Whether a free trial applies, its length and the price you pay after it are shown before you purchase. If you don’t cancel at least 24 hours before the trial ends, the yearly subscription starts and you are charged the yearly price. Any unused portion of a free trial is forfeited when you purchase a subscription.
  • If you close the subscription screen without subscribing and have never subscribed to Jollyjack Pro before, the App may offer you the Yearly Offer: a yearly plan at a special price, with no free trial, that renews every year. Its price and terms are shown before you purchase.
  • Payment is charged to your Apple Account when you confirm the purchase, or when a free trial ends.
  • Your subscription renews automatically for the same period at the then-current price unless it is cancelled at least 24 hours before the end of the current period. Your account is charged for renewal within 24 hours before the end of the current period.
  • You can manage or cancel your subscription at any time in your Apple Account settings: on your iPhone, open Settings, tap your name, then Subscriptions. In Jollyjack, Settings › Subscription › Manage subscription opens the same page. Deleting the App or your account does not cancel your subscription.
  • If you change iPhones or reinstall the App, use Settings › Subscription › Restore purchases or Restore on the subscription screen.
  • From time to time we may offer other special prices. The terms of an offer are shown before you purchase.
  • Purchases are processed by Apple. Refunds are handled by Apple in accordance with Apple’s policies.

6. Acceptable use

You agree not to:

  • copy, modify, distribute, sell or lease any part of the App or its content;
  • reverse engineer or attempt to extract the source code of the App, except where the law allows it;
  • bypass or interfere with subscription checks or security features;
  • use the App to cheat, or in any way that breaks the law or the rules of a venue;
  • send feedback or other content that is unlawful, abusive or infringes someone else’s rights.

7. Training content

The App’s strategy charts, counting systems, probabilities and coaching are provided for education. We work to keep them accurate, but they may contain errors, and the best play can depend on the exact rules of a table.

8. Feedback

If you send us feedback or ideas, we may use them to improve the App without any obligation to you.

9. Intellectual property

The App and its content, including lessons, drills, illustrations, the Jolly character and the Jollyjack name and logo, are owned by us or our licensors and are protected by intellectual property laws. Fonts and sounds licensed from third parties are listed in the App under Settings › About › Acknowledgements. These Terms do not transfer any ownership rights to you.

10. Third-party services

The App uses services provided by third parties, including Apple, Google and Superwall. Your use of those services may also be subject to their own terms and privacy policies.

11. Apple

  • These Terms are between you and us, not Apple. Apple is not responsible for the App or its content.
  • Apple has no obligation to provide any maintenance or support services for the App.
  • If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price, if any, for the App. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
  • Apple is not responsible for addressing any claims by you or any third party relating to the App or your possession or use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims arising under consumer protection, privacy or similar legislation.
  • Apple is not responsible for the investigation, defense, settlement or discharge of any third-party claim that the App or your use of it infringes that third party’s intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms and, once you accept them, Apple may enforce these Terms against you as a third-party beneficiary.

12. Disclaimer of warranties

To the fullest extent permitted by law, the App is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee that the App will be uninterrupted or error-free, or that it will improve your results at any game.

13. Limitation of liability

To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of money, data or profits, arising from or related to your use of the App, including any gambling decision you make outside the App. Our total liability for any claim relating to the App will not exceed the amount you paid for the App in the twelve months before the claim. Nothing in these Terms limits liability that cannot be limited under applicable law.

14. Termination

You may stop using the App and delete your account at any time, as described in section 4. We may suspend or terminate your access if you violate these Terms. Sections that by their nature should survive termination will continue to apply.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will change the effective date above, and if the changes are significant we will let you know in the App. Continuing to use the App after changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Georgia (the country), without regard to its conflict of laws rules. This does not deprive you of any mandatory consumer protections under the laws of the country where you live.

17. Responsible play

Jollyjack is for learning. If gambling ever stops being fun, take a break and talk to someone you trust or a local support service.
